During his appeal hearing this week, the Supreme Court Prosecutor has asked the judge to uphold the three prison sentence handed down to Torrevieja´s former Mayor, Pedro Hernández Mateo of the Partido Popular, for committing falsehood and prevarication in awarding a contract for waste disposal.
The defence lawyer said the decision to award the contract “was not the mayor´s, but the Local Government Board”, and therefore Hernández Mateo is not singularly responsible. Both the prosecutor and the private prosecutor claimed that the consideration of the procedure as a whole is that Hernández Mateo resorted to “inventions”, as well as “violations of the laws”, “simulating the legal process”.
The defence counsel has requested the acquittal on the grounds that there had been even “administrative irregularities”. According to the Prosecutor, a comprehensive examination of all the proceedings of the former Mayor reveals that he participated in the decision process of the major contract awarded to UTE Necso.
The former mayor of Torrevieja was sentenced in November 2012 by the High Court of Valencia to three years in prison and seven years disqualification from holding public office. The final judgment will be known within 40 days.
